Policy Limits Demand - Strategies and Complications in a Covid Impacted Court System

The presentation will focus on a “policy limits demand,” its potential impact, the underlying defense counsel role, the carrier role.  We will address when and how we typically see the demands.  We will discuss how to handle and communicate them, including from the perspectives of the attorneys versus adjuster’s roles in handling, communicating, analyzing, and responding to the demands – carrier, to client to adverse.  We will touch on the role of the tripartite relationship and obligations arising from same, as well as the impact of the demand and response on extracontractual risk.  We will identify some new trends we are seeing with these demands in the time of Covid-19 pandemic, which has resulted in more difficult access to the Courts, trial dates and, in some circumstances, longer file lives.  Finally, we will lay out some hypothetical applications.
